The Consell de Formentera recently approved two administrative<\/span><\/strong>\u00a0penalties related to tourist activities and events held in homes on the island. Both cases were linked to violations considered very serious under regional regulations, although they involved different situations: the irregular marketing of tourist accommodation and the organization of an illegal party.<\/p>\n

On the one hand, the island institution reviewed a proposed fine related to a tourist establishment in the area of La Savina. After analyzing the allegations submitted by the company involved, the Administration decided to modify its initial criteria and significantly reduce the amount of the penalty.<\/p>\n

On the other hand, the Consell also imposed a financial penalty on a promoter who organized an illegal party in a private home on the island. Fine for irregular tourist rental<\/span><\/strong><\/span><\/h2>\n


The Governing Board of the Consell de Formentera approved the reduction of a sanction initially proposed at \u20ac530,000, lowering it to \u20ac82,000 after reviewing two sanctioning proceedings related to the irregular marketing of tourist accommodation.
\nThe proceedings had been opened following an inspection carried out on September 5, 2024, at two establishments located in La Savina and operated by the companies Formentera Mar, S.A. and Salinera Espa\u00f1ola, S.A. Both properties were part of the same tourist operation located on the same plot and marketed under the commercial name Cas Saliners.<\/p>\n

Initially, the Administration had processed two separate cases: one related to the building known as Cas Carabiners and another concerning the establishment called Casa Gran. In the first case, the marketing of a number of apartments and guest places exceeding the authorized limit was detected, while in the second case the tourist operation of nine units with capacity for 35 places was confirmed without the required authorization.
\nThe original sanction proposal amounted to \u20ac480,000 in the case of Casa Gran and \u20ac50,000 in the case of Cas Carabiners. Reduction of the penalty<\/strong><\/span><\/h2>\n

After reviewing the case file, the Consell\u2019s legal services concluded that the initial amount had to be adjusted based on proportionality criteria. Instead of taking all the units attributed to the establishment as a reference, the Administration decided to base the calculation solely on the income that could be verified during the inspection.
\nSpecifically, the inspection report recorded three apartments occupied at that time. The verified payments corresponded to \u20ac2,350, \u20ac4,231.30 and \u20ac600 respectively.<\/p>\n

Based on these amounts, and maintaining the classification of a very serious tourism-related violation, the final penalty was set at \u20ac82,000, an amount that was ultimately approved by the Governing Board.
\nDuring the processing of the procedure, the Administration rejected the rest of the allegations submitted by the company. The Consell defended the validity of the actions carried out by the Tourism inspector and recalled that reports issued by public officials in the exercise of their duties carry a presumption of accuracy.<\/p>\n

<\/h2>\n

Fine for organizing an illegal party<\/strong><\/span><\/h2>\n

In a separate case, the Consell de Formentera agreed to impose a fine of \u20ac100,000 on the promoter of an illegal party planned in a house located in the area of Venda de Ses Clotades, between es Cal\u00f3 and Pilar de la Mola.
\nThe case originated from two reports filed by the Local Police on July 30 and 31, 2023, after several neighbors warned about the possible celebration of an unauthorized event.<\/p>\n

Although the party ultimately did not take place, the Administration considered that its prior organization had been proven. According to the case file, access to the event was being marketed through WhatsApp messages at a price of \u20ac50, payable via Bizum.<\/p>\n

The documentation also indicated the existence of a closed guest list, the requirement to present ID at the entrance, and the hiring of security personnel. In addition, the event included transportation for attendees, food, an open bar, and music provided by DJ Amfer.

The homeowner was cleared of responsibility<\/strong><\/span><\/h2>\n

In the same procedure, the possible responsibility of the property owner was also investigated. However, the final decision ruled out her involvement in the events.
\nThe owner submitted a temporary rental contract for the property signed with the event organizer, which explicitly prohibited the celebration of parties. She also provided a notarial record of the damage caused to the house and a complaint filed with the Guardia Civil when she became aware of what had happened.<\/p>\n

For his part, the promoter\u2019s defense requested the dismissal of the case, arguing that the party had never actually taken place. The Consell\u2019s legal services rejected this argument, recalling that Balearic regulations sanction not only the celebration of illegal parties but also their organization, promotion, or commercialization.
