In the never-ending resolution of the allocation of beach kiosks in Formentera, another twist was added yesterday to the confusing political and legal situation surrounding this competition.
Seven of the highest-rated companies by the Contracting Board submitted a recusal document against the president of the Consell de Formentera, Llorenç Córdoba, and the Human Resources lawyer, María Teresa Ferrer.
The recusal, a legal term implying the request to remove a judicial or administrative authority from a procedure due to suspicions about their impartiality, has generated an immediate impact.
The Secretary of the Insular Council, Angel Custodio Navarro, announced yesterday, Tuesday, the suspension of the Government Board scheduled for today, Wednesday, due to “overlapping legal reasons” regarding the submitted recusal.
The suspension of the Government Board, from which it seemed a definitive decision would finally emerge, has been the first consequence of the submitted recusal, once again postponing the decision. This situation leaves residents and regular tourists of the island in suspense, who don’t understand how it has come to this point with two completely opposing positions, just days before the start of the tourist season.
The seven highest-rated companies by the Contracting Board, through their legal representative, Javier Jiménez de Cisneros Cid, request that both President Llorenç Córdoba and the Human Resources lawyer of the Consell, Teresa Ferrer, abstain and recuse themselves from the processing and resolution of the competition’s award procedure, casting doubt on their impartiality as both insist on declaring the competition void. Meanwhile, the rest of the councilors, both from the government and the opposition, demand that the resolution of the Contracting Board be followed.
Apparently, this recusal must be resolved within a maximum of three days.
We absolutely have no idea what procedure will be followed from now on, nor the consequences and legal actions that the different parties affected by this competition may undertake. The truth is that no one knows for sure if the kiosks will be open this coming summer or who would manage them if they were to open. Undoubtedly, it’s a very uncertain and unpleasant situation for all residents and visitors of Formentera.
As citizens affected by all these disagreements, all we can do is hope and wish that this soap opera ends soon. We will provide further updates on this blog as soon as there are any developments.
Today at noon (after the initial publication of this post), the president of the Consell de Formentera, Llorenç Córdoba, announced that he will distance himself from the final decision regarding the allocation of lots in the beach kiosk competition. In his place, he will allow a Government Board, composed of the other consellers, to make the necessary determination.
With this move on his part, it seems clear that the decision made by the Contracting Board will be implemented, as Córdoba was the only conseller advocating a proposal different from that expressed by said body.
This proposal to award to the highest-rated companies has been supported by the other consellers, both from the governing team and the opposition.
Therefore, unless there is an unexpected turn of events beforehand, in the next convened Government Board, the allocation of beach kiosks should finally be approved.
