News at Bartolito’s Beach Kiosk

The Contracting Board of the tender for the eight beach kiosks in Formentera, after reviewing once again all the reports submitted at the time, considers that the company rated highest in the tender for lot 27 at Es Copinar Beach, Tafa Merenglen, did not submit the supplementary documentation required, including proof of professional technical solvency and failure to demonstrate the rectification of necessary requirements before the award. Additionally, some of the requested documentation was not translated into Catalan or Spanish.
Therefore, it has been decided to propose to the Governing Board of the Consell to request from the bidder Bartomeu Escandell Torres, the current concessionaire of the so-called Bartolito Kiosk and second-place bidder in the tender, the documentation specified in the tender specifications. This bidder now has a period of 10 working days to complete it.
Bartomeu Escandell Torres, along with other former beach kiosk owners, has been critical of the ongoing tender and was in favor of declaring the current tender void and calling for a new one, following the line of the Consell President, Llorenç Cordoba
Continuing with the rest of the report, the Contracting Board has proposed to the Governing Board to award the remaining seven kiosks to the initially highest-rated companies that have completed the required documentation. Therefore, following the outlined criteria, these kiosks would be managed by the winners of the latest tender, and none of the former concessionaires would continue operating in these kiosks.
With this new report from the contracting board, published yesterday on the State public contracts platform, the tender continues as no entity has withdrawn from it or declared it void, as the President of the Consell has insisted several times, citing various legal opinions supporting such a decision. It is yet to be decided whether the Governing Board or a Plenary Session of the Insular Council should be convened next to proceed with the process.
Yesterday, prior to the Contracting Board’s report, Llorenç Córdoba went on Radioilla to reaffirm his decision to abandon the current tender and call for a new one.
However, considering that this process would take time and the lots are already awarded for this season, Córdoba proposed reaching out to the former managers of the kiosks to ensure continuity of service during the summer of 2024. To do so, he has contacted the Balearic Government, responsible for coastal competencies, to obtain temporary authorizations.
